Subject to the terms set out below, The Colour Flooring Company Limited (the Company) warrants its flooring against defects in material under normal use for a period of ten (10) years from the date of original purchase. If a defect arises and a valid claim is received by the Company within the warranty period, at its option and to the extent permitted by law, the Company will either: (a) repair the flooring at no charge; (b) exchange the flooring with flooring that is new or equivalent to the original flooring; or (c) refund the purchase price of the flooring, reduced by an appropriate amount to take account of prior usage. Flooring repaired or replaced during the warranty period will be warranted for the remainder of the original warranty period or for sixty (60) days from the date of repair or replacement, whichever is longer.
Any claim under this warranty is subject to you:
(a) Notifying the Company of the alleged defect within 30 days of it having come to your attention and in any event no later than before the expiry of the warranty period; and
(b) Providing a copy of the original invoice.
The Company shall have no liability in respect of any defect in the flooring arising from fair wear and tear, neglect, a failure to follow the Company’s instructions, improper installation or maintenance, installation of the flooring in an inappropriate environment or any other damage whatsoever caused by external factors.
The Company shall under no circumstances be liable for any loss of profit, or any indirect or consequential loss arising out of or in connection with the supply of flooring.
The Company’s total liability in respect of all other losses arising out of or in connection with the flooring, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall in no circumstances exceed the price paid for the flooring.
Nothing in this warranty shall limit or exclude the Company’s liability for death or personal injury caused by its negligence or any other matter in respect of which it would be unlawful for the Company to exclude or restrict liability.
